Terms and Conditions – Mojassam Technologies
1. Definitions
“The Company” refers to Mojassam Technologies.
“The Client” refers to the person, entity, or institution that purchases products or services from the company.
“The Products” refers to all manufactured parts, prototypes, 3D printing products, engineering components, or any products provided by the company.
“The Services” refers to design, engineering, consulting, manufacturing, 3D printing, modeling, 3D scanning, installation, or any other technical services provided by the company.
2. Prices and Pricing Offers
2.1 All pricing offers are valid for fourteen (14) days from the date of issuance unless otherwise stated.
2.2 All prices are in Saudi Riyals and include Value Added Tax unless otherwise specified.
2.3 The company reserves the right to modify prices in the following cases:
Changes in raw material prices
Modification of the scope of work
Change requests from the client
Changes in delivery requirements
Addition of additional engineering or operational work
2.4 Any additional work requested after the approval of the offer is considered outside the scope of the original offer and will be charged separately.
3. Order Confirmation
3.1 An order is considered confirmed when:
The offer is approved in writing
A Purchase Order (PO) is issued
Or the required deposit is paid
3.2 After production has started, the order cannot be canceled except with written consent from the company.
4. Payment Terms
4.1 Payment terms are specified in the pricing offer or invoice.
4.2 Unless otherwise agreed:
Custom projects require a deposit before execution or manufacturing begins.
The remaining amount must be paid before delivery or shipping.
4.3 The company has the right to stop work or delay delivery in case of payment delay.
4.4 The client bears all bank transfer fees and financial charges related to payment.
5. Design Approval and Confirmations
5.1 The client is responsible for reviewing and approving all designs, drawings, dimensions, specifications, and samples before manufacturing begins.
5.2 The company bears no responsibility for errors approved by the client after final approval.
5.3 Any modifications after approval may affect the price and execution time.
6. Production and Execution Time
6.1 The mentioned execution times are considered estimates and depend on:
Material availability
Production capacity
Project complexity
Client response speed
6.2 The company bears no responsibility for any delays resulting from circumstances beyond its control, including but not limited to:
Supplier delays
Shipping issues
Customs procedures
Technical malfunctions
Emergency situations or force majeure
7. Delivery and Shipping
7.1 Delivery dates are estimates unless a specific date is agreed upon in writing.
7.2 The responsibility for the products transfers to the client when:
Direct receipt
Delivery to the shipping company
Or leaving the company's premises
7.3 The client bears shipping, insurance, and customs fees unless otherwise agreed.
7.4 The client must inspect the products within three (3) working days from the date of receipt and notify the company of any comments in writing.
8. Manufacturing Variability
8.1 Due to the nature of custom manufacturing, 3D printing, machining, and engineering manufacturing, slight differences may appear in:
Dimensions
Finishes
Layers
or Colors
8.2 Standard industrial tolerances apply unless specific specifications are agreed upon.
8.3 Differences in color shades between batches of materials are not considered a manufacturing defect.
9. Intellectual Property and Confidentiality
9.1 All designs, drawings, models, and engineering files developed by the company are considered the intellectual property of the company unless otherwise agreed in writing.
9.2 The company is committed to maintaining the confidentiality of the client's files and information.
9.3 The company has the right to use images of completed projects for marketing and showcasing purposes unless a confidentiality agreement has been signed in advance.
10. Warranty and Liability
10.1 The company guarantees that the products will conform to the agreed specifications at the time of delivery.
10.2 The warranty does not cover:
Misuse
Incorrect installation
Modifications by a third party
Normal wear and tear
Exposure to unsuitable operating conditions
10.3 The company's liability is limited to the value of the product or service in question only.
10.4 The company is not liable for any indirect or consequential losses such as:
Business interruption
Loss of profits
or operational delays
11. Returns and Exchanges
11.1 Custom-made products are non-returnable or refundable unless there is a proven manufacturing defect.
11.2 Requests for exchanges or compensation are subject to inspection and approval by the company.
11.3 Unused standard products may be returnable within three (3) days according to the company's policy.
12. Client Responsibility
12.1 The client acknowledges that they hold the legal rights to use or manufacture any designs, logos, or files provided to the company.
12.2 The company shall not bear any legal responsibility related to the infringement of intellectual property rights resulting from files submitted by the client.
13. Force Majeure
The company shall not be liable for delays or inability to perform due to circumstances beyond its control, including but not limited to:
natural disasters
government regulations
supply chain disruptions
power outages
wars
epidemics
or transportation and shipping issues
14. Applicable Law
These terms and conditions are subject to the laws and regulations of the Kingdom of Saudi Arabia, and the competent courts within the Kingdom of Saudi Arabia shall be the authorized body to consider any disputes.
15. Acceptance
The acceptance of the price offer, issuance of a purchase order, payment of installments, or receipt of products shall be deemed implicit acceptance of all the aforementioned terms and conditions.
